El propósito de los autoreses mostrar que, a pesar de los muchos elementos modernos de la novela,los consejos reflejan una concepción clásica —y no moderna— de la justiciay el derecho. Esta concepción clásica pasa del Medioevo a Cervantes através de la Segunda Escolástica, que, si bien se enfrenta a problemas modernos,sigue siendo una corriente de pensamiento anclada en la doctrinaaristotélico tomista del derecho natural. La metodología utilizada consisteen un análisis filosófico jurídico a partir de las fuentes cervantinas.Don Quixote and his vision of justice and law: about theadvices for the government of Barataria islandIn this paper we analyze some of the advices given by Don Quixote to Sanchofor the government of the Barataria Island. The purpose of the authors is toshow that, despite the many modern elements of the novel, the advices reflecta classic —and non modern— conception of justice and law. This classical conceptionpasses from the Middle Ages to Cervantes through the Second Scholastic,which, while facing modern problems, remains a current of thought anchoredin the Aristotelian Thomistic doctrine of natural law. The authors try to show that Doctor Eximius reveals a deep concern for the human-social aspect of work, approaching in this matter some postulates of modern labor law. In this sense, Suárez’s position differs from that held by other scholastics of the 16th-17th centuries, who limited themselves to discussing the problems of the relationship between work and fair wages within a primarily economic framework.Item type: Item , Los juicios de proporcionalidad en la teoría moral y jurídica de la escolástica española aurisecular(Autonomous University of Madrid, 2021) Alejandro Miranda MontecinosThis work analyzes the criteria used by the moralists and jurists of Spanish scholasticism (16th and 17th centuries) to carry out proportionality judgments. The author tries to show that the scholastics made important contributions to the development of a theory that, recognizing the incommensurability of fundamental human goods and evils, accepts that it is possible to make comparisons that allow us to speak of greater good (or evil) or lesser good (or evil).
