    La celebración de capitulaciones en la unión marital de hecho

    Este articulo presenta los resultados del proyecto de investigacion titulado “La celebracion de capitulaciones en la union marital de hecho”, con el que se quiso dar respuesta al problema de investigacion materializado en el siguiente interrogante: ?En que momento pueden celebrar capitulaciones maritales los companeros permanentes? A partir de la consideracion hipotetica de que tales momentos podrian ser: antes de iniciar la union marital de hecho, antes de constituir la sociedad patrimonial de hecho o una vez consolidada la misma, se utilizo un tipo de investigacion descriptivo con un diseno de campo que permitio, a traves de la aplicacion de un instrumento, recolectar la informacion necesaria en todas las notarias del Circulo de Bogota. Tambien se recurrio a un diseno bibliografico para la recaudacion de los datos secundarios, cuyas fuentes principales fueron la doctrina, la legislacion y la jurisprudencia. El analisis efectuado desde lo cualitativo y lo cuantitativo permitio establecer que existe ausencia legislativa respecto del momento en el que el pacto capitular puede ser celebrado, razon por la que se encontraron escrituras publicas firmadas en diferentes momentos

    THE MAKING OF CONTRACTS IN COMMON-LAW MARRIAGES

    The present paper includes the results of a research project titled ‘The Making of Contracts in Common-Law Marriages’, the purpose of which was to answer the following question: At what moments may permanent partners sign a common-law marriage contract? Based on the hypothetical consideration that such moments may be: before starting the common-law marriage, before constituting the common-law patrimonial company or just after constituting it, a descriptive type of research was used, together with a field design that allowed for the recollection of the necessary information from all the notaries in the Circle of Bogota, through the application of a tool. We also resorted to a bibliographical design for the gathering of secondary data, the main sources of which were doctrine, legislation and jurisprudence. The analysis carried out both quantitatively and qualitatively allowed us to establish that there is a legislative absence regarding the moment in which the mentioned contract may be constituted, which is why public scriptures were found that had been signed at different times
