    ¿Stare Decisis o uso selectivo de los antecedentes judiciales?: un análisis del rol de las decisiones judiciales como fuentes del Derecho Internacional

    El propósito del presente artículo es revisar algunos sectores de la doctrinay ciertos antecedentes jurisprudenciales de tribunales internacionales, conel fin de analizar cuál es el valor jurídico, en términos de fuentes del derecho internacional, de las decisiones judiciales. La propuesta del artículo es analizar, desde la perspectiva de la escuela del realismo jurídico, cuál es el derecho internacional en los libros, cuál es el derecho internacional en acción y cuál es su relación, en lo que tiene qué ver con el valor jurídico de las decisiones judiciales. La conclusión del artículo es que las decisiones judiciales son parte fundamental en el desarrollo del derecho internacional y, en consecuencia, los árbitros y jueces deben estar familiarizados con las mismas para cumplir su función vital en el proceso de adjudicación: conocer y aplicar el derecho internacional.

    STARE DECISIS OR SELECTIVE USE OF JUDICIAL DECISIONS?: AN ANALYSIS OF THE ROLE OF JUDICIAL DECISIONS AS SOURCES OF INTERNATIONAL LAW

    The purpose of this article is to review some opinions of highly qualifiedpublicists and certain judicial decisions from international tribunals, withthe object to analyze which is the legal weight, in terms of sources of international law, of judicial decisions. The proposal of the article is to analyze, from the perspective of the school of legal realism, what is the international law in the books, what is in the international law in action, and what is the relation between them, with respect to the legal weight of judicial decisions. The conclusion of the article is that judicial decisions are a fundamental part of the development of International Law, and hence arbitrators and judges should be familiarized with them in order to fulfill their vital function in the process of adjudication: knowing and applying International Law.
