LA INJERENCIA DEL ÓRGANO EJECUTIVO SOBRE EL TRIBUNAL CONSTITUCIONAL: EL CASO BOLIVIANO
    (2020) Sonia Eliana Roca Serrano
The purpose of separation of powers is to balance and limit the power to just one branch. The separation prevents the power and sovereignty of the state from resting on only one person or group of people. In the Plurinational State of Bolivia, the separation of branches and the distribution of powers are stipulated by constitutional mandate. This is organized on the basis of four branches: judiciary, legislative, executive, and electoral. In the research presented here, we analyze on the one hand the Constitutional Court’s ruling 084/17, and on the other, Constitutional declaration 003/13, wherein the interference of the executive power –through the legislative power– over the Constitutional Court of Bolivia is clear to see.
