    La reforma del proceso civil era un mandato de la Constitución de 2006, la Ley del Órgano Judicial (Ley 025 de 24 de junio de 2010), la nueva realidad social y los adelantos tecnológicos que exigieron un nuevo sistema de justicia civil que garantice los derechos sustantivos. En realidad el código de procedimiento civil de 1976, y su reforma parcial mediante ley Nº 1760, de 28 de febrero de 1997, pese a la opinión de sus mentores en lo fundamental supuso un intento vano de reforma , porque en los hechos el proceso continuaba lento burocrático y funcional a la corrupción. | The reform of the civil process was mandated by the 2006 Constitution, the Judicial Branch Law (Law 025 of 24 June 2010), the new social reality and technological advances that demanded a new civil justice system that guaranteed substantive rights. In reality, the 1976 code of civil procedure, and its partial reform by Law No. 1760 of 28 February 1997, despite the opinion of its mentors on the fundamentals, was a vain attempt at reform, because in fact the process continued to be slow bureaucratic and functional to corruption. | Capítulo 1.
