    Análisis crítico de la ley de gestión integral de riesgos socio-naturales y tecnológicos.

    Risk is intrinsic to humans for the simple reason that it is part of nature and wherever a human being may live, there will be a latent threat that could endanger his/her personal security or that of his/her family or neighbour´s. In order to prevent or minimize risks, be ready to face a risk that turns into an actual threat, recover from a major traumatic event and try to return to normality as it was known previous to that traumatic event, any organized community, whether it is a town, municipality, city, state, country, or otherwise requires actions that form part of a comprehensive plan for the management of risks . Socio-natural and technological risks frequently occur without prior warning, and once they ensue they have no boundaries, therefore they merit, and, in fact, they are the focus of global concern. This concern has prompted the development of agreements and multinational treaties that oblige the signatory nations to provide financial and operational support to those affected by natural or manmade disasters. Each sovereign country strives to have in place a domestic functional and operational framework to effectively manage risk within its boundaries. This is achieved through the creation of laws that legally enables the State to regulate its citizens’ actions and behavior in matters related to comprehensive risk management. In this paper we will comment on the most recent and still in force law in Venezuela related to the subject. We will review the Organic Law for the comprehensive management of socio-natural and technological risks published in 2009, and comment on its functional and legal aspects.

    Comentarios a la nueva ley penal del ambiente y su concordancia con otras normas vigentes

    The new penal law of the environment published in may, 2012, replaces the 1992 law of the same name. The new law provides some analysis and a commentary upon the narmative character of the current law comparisons to other up-to-date norms of jurisprudence. In a similar way, we find in it an identification and differentiation of offenses concerning damage and dangers as a result of actions and inaction that may be considered as going under the heading of offenses typified under the third section of the law.

    Consideraciones generales sobre la Ley de Bosques y Gestión Forestal

    El Tropico es, por naturaleza, rico en vegetacion. Venezuela es un pais tropical y su vegetacion es abundante y diversa. Destaca su Patrimonio Forestal, conformado por unas 50 millones de hectareas de bosques altos y medios potencialmente productores de materia prima para la industria maderera nacional, ademas de unas 700 mil hectareas de plantaciones, algunas privadas, con el mismo fin. Una nueva normativa en materia de bosques y gestion forestal promulgada en Junio de 2008 derogo el contenido forestal de la anterior y obsoleta Ley Forestal, de Suelos y Aguas, redistribuyendo entre diversos entes del Estado venezolano la competencia legal en materia forestal, que era casi exclusiva del Ministerio del Poder Popular para el Ambiente; en un intento por regular en forma mucho mas efectiva su explotacion y aprovechamiento para beneficio del colectivo. El contenido normativo de este Decreto con Rango, Valor y Fuerza de Ley no difiere sustancialmente del proyecto original presentado por el ente competente para discusion publica segun la ley, a pesar de las multiples y variadas observaciones formuladas por expertos, industriales, tecnicos, investigadores y docentes, relacionados con este campo especifico del conocimiento.

    Rasgos de una ciudad del conocimiento, distinguida y sostenible

    Definir los rasgos que distinguen a una ciudad, es descifrar los mas sentidos significados de expresiones, escenarios y variedad de dinamicas humanas y naturales que la hace particular y distinta a otra. Es la dimension de amalgamar lo material e inmaterial dentro de un territorio determinado. De ahi que, el presente compendio proyecta los rasgos que dibujan la esencia de la particularidad de la ciudad de Merida, Venezuela, como una ciudad de altura, caracterizada historicamente, por ser una urbe de conocimiento, distincion y con el interes de un grupo de ciudadanos, alcanzar a mediano plazo, su sostenibilidad. Es apertura de una vision prospectiva de la Merida del 2020, 2030 o 2050, cuyos argumentos focalizan el equipamiento de servicios para una vida de calidad, tranquilidad, seguridad y alegria, con la renovacion de ambitos emblematicos y espacios publicos humanizados; agoras como lugares de encuentro para la recreacion; el esparcimiento y las manifestaciones del arte; la produccion de bienes materiales y la entrega de bienes inmateriales; la siembra de centros de innovacion y conocimiento; de arterias viales para circulacion y la comodidad de transeuntes y pasajeros; de parques para acercar la ciudad a la naturaleza; caracterizada por su ornato, colorido y limpieza urbana, entre muchos otros. Abstract Virtue of a city of knowledge, distinguished and sustainable Defining the traits that distinguish one city from others is to decipher the meanings of heartfelt expressions, the scenery, and the varieties of natural and human dynamics. It is the amalgam of material and immaterial factors within a given territory. Hence, this article features the essence of particularities of the city of Merida, Venezuela, historically distinguished as a city of high quality, knowledge, distinction, and a community of interested citizens, for achieving its medium-term sustainability. It is a starting point of envisioning Merida 2020, 2030, or 2050, contention of which focuses on providing services for quality life, peace, security and happiness. Implications are in such areas as public plazas designated for recreational events, entertainment, and art exhibits; the delivery of material goods and intangible properties; building of centers for innovations and knowledge as well as improving major thoroughfares in view of passengers’ and pedestrians’ comfort; providing parks with colorful ornaments so as to make the city closer to the nature, and urban sanitation, among others.
