Inoperatividad de la medida cautelar del secuestro, determinado en el artículo 326 parágrafo IV del código procesal civil boliviano

Abstract

En consecuencia, la aplicación de esta norma, tiene como consecuencia que prácticamente nunca se pueda ejecutar el secuestro de bienes muebles para asegurar los resultados de la sentencia; aspecto que en los hechos impide garantizar la reparación inmediata de los derechos de la parte victoriosa, por ende tal situación perjudica a la ejecución de la sentencia, al no contar con una garantía material para hacer eficaz el cumplimiento de la misma, además de beneficiar con esta medida a una sola de las partes dejando afectado el objetivo primordial del proceso en este caso el resguardo del derecho que sebusca precautelar. | Consequently, the application of this rule has the consequence that the seizure of movable property for the purpose of the sale of to ensure the results of the judgement; an aspect which in fact prevents guarantee the immediate redress of the rights of the victorious party, by such a situation adversely affects the execution of the judgment, since it does not have an the material guarantee to make effective the fulfillment of the same one, in addition to to benefit with this measure only one of the parties leaving affected the the primary objective of the process in this case the safeguarding of the right that is is looking for caution. | Capítulo 1.
