Este estudio propone una reforma legal que permita a las parejas convivientes optar entre la sociedad de gananciales y la separación de patrimonios. Se empleó un enfoque cuantitativo, aplicando encuestas para analizar la percepción ciudadana sobre la regulación vigente. Los resultados evidenciaron que la imposición de un único régimen patrimonial vulnera la dignidad y el derecho de propiedad de los convivientes. Se concluye que la reforma fortalecería la protección legal de las uniones de hecho, garantizando el respeto a la autonomía patrimonial y promoviendo la igualdad jurídica en las relaciones de convivencia.The current regulation of de facto unions in the Peruvian legal system imposes the regime of community of acquisitions without allowing the free choice of the patrimonial regime, which affects the autonomy and legal security of the cohabitants. This study proposes a legal reform that would allow cohabiting couples to choose between the community of acquisitions and the separation of assets. A quantitative approach was used, applying surveys to analyze citizen perception of the current regulation. The results showed that the imposition of a single property regime violates the dignity and property rights of cohabitants.
