Calderón Medrano, Carlos Alberto2026-03-232026-03-2320242413-2810http://www.scielo.org.bo/scielo.php?script=sci_arttext&pid=S2413-28102024000100012&tlng=eshttps://andeanlibrary.org/handle/123456789/97763Vol. 13, No. 20El presente artículo tiene el objetivo de desarrollar de manera analítica la configuración de un control multinivel como mecanismo de vigencia y protección de los Derechos Fundamentales, proponiendo el análisis de la protección y control tutelar desde distintos ángulos, y una diferenciación entre Derechos Humanos y Derechos Fundamentales; en ese sentido, para el caso de los derechos fundamentales, se establecerá que un garante primario es aquella autoridad judicial o administrativa que en primera instancia protege y garantiza el derecho en el Estado, y que en un segundo nivel de garantía, se sitúa el Control Tutelar de Constitucionalidad, que puede estar a cargo de un Órgano Especializado denominada Corte Constitucional o Tribunal Constitucional, y finalmente, si el derecho se sitúa dentro de la Convención Americana de Derechos Humanos, este derecho será objeto de un Control de Convencionalidad por la Corte Interamericana de Derechos Humanos, como un garante terciario de los derechos, y también de manera general por el Sistema de Protección Universal de Derechos Humanos, a través de Naciones Unidas. De esta manera se encuentran algunas distinciones, por el Órgano que ejerce control, procedimientos, alcance y naturaleza, que aporta al análisis de aquel control multinivel de los derechos fundamentalesSummary The purpose of this article is to analytically develop the configuration of a multilevel control as a mechanism for the enforcement and protection of Fundamental Rights, proposing the analysis of protection and tutelary control from different angles, and a differentiation between Human Rights and Fundamental Rights; In this sense, in the case of fundamental rights, it will be established that a primary guarantor is the judicial or administrative authority that in the first instance protects and guarantees the right in the State, and that in a second level of guarantee, the Tutelary Control of Constitutionality is situated, which can be in charge of a Specialized Body called Constitutional Court or Constitutional Tribunal, and finally, if the right falls within the American Convention on Human Rights, this right will be subject to a Control of Conventionality by the Inter-American Court of Human Rights, as a tertiary guarantor of rights, and also generally by the Universal Protection System of Human Rights, through the United Nations.
