Abstract
El estudio de la problemática no se limita al enunciado literal, por lo relevante del sin número de personas que se encuentran bajo arresto domiciliario sin fecha de culminación. El objetivo de esta investigación es diseñar un anteproyecto de ley reformatoria al Código Orgánico Integral Penal en lo referente al arresto domiciliario para garantizar el principio de igualdad y el derecho a transitar libremente en el territorio nacional. La investigación se conduce bajo el enfoque mixto, diseño exploratorio, descriptivo y revisión bibliográfica exhaustiva. Se aplicó un cuestionario cuya población está conformada por 85 individuos. Se concluye que la normativa constitucional en el Ecuador contempla los supuestos de abuso arbitrarios de las herramientas jurídicas para el detrimento de derecho y garantías, la imposición de no caducidad del arresto domiciliario supone la violación al debido proceso y la igualdad, lo que debe generar un proyecto de ley que procure suplir y solucionar las falencias creadas por la mala aplicación de la norma.
The study of the problem is not limited to the literal statement, due to the relevance of the countless people who are under house arrest with no end date. The objective of this research is to design a draft reform law to the Comprehensive Organic Criminal Code regarding house arrest to guarantee the principle of equality and the right to move freely in the national territory. The research is conducted under a mixed approach, exploratory, descriptive design and exhaustive bibliographic review. A questionnaire was applied whose population is made up of 85 individuals. It is concluded that the constitutional regulations in Ecuador contemplate the cases of arbitrary abuse of legal tools to the detriment of rights and guarantees, the imposition of no expiration of house arrest supposes the violation of due process and equality, which should generate a bill that seeks to supplement and solve the shortcomings created by the poor application of the norm.
