Consentimiento informado del menor en el ámbito de la sanidad y la biomedicina en España

Abstract

En España el consentimiento informado del menor se regula en la legislación estatal y autonómica relativa a la autonomía de la voluntad del paciente. En ella, el mayor de 16 años puede otorgar su consentimiento por sí mismo, mientras que se establece el consentimiento por representación de los padres o tutores para el menor de esta edad, debiendo dar información a los mayores de doce años, salvo los casos de limitación del consentimiento, en las que podrá actuar el médico. Sin embargo, no se regula con precisión el consentimiento del menor maduro de edad inferior a 16 años. En situaciones de conflicto, se puede recurrir a la autoridad judicial, aunque existen otras medidas para resolver dichos conflictos. Existe regulación concreta en supuestos específicos (interrupción embarazo, investigación biomédica, ensayos clínicos, extracción órganos, transexualidad).
