Abstract
En el presente artículo se estudia el ámbito de aplicabilidad de la prohibición de competencia sobre el sujeto pasivo, considerándose que este es el actor principal sobre el que recaerán todas las posibles actividades concurrenciales -sean actuales o potenciales. Los cambios constantes en la normativa positiva y la evolución de la gestión corporativa, han desarrollado mayores controles de análisis y estudio sobre la participación, enrolamiento, administración y correspondencia del sujeto pasivo en la Sociedad
In this article, the scope of applicability of the competence prohibition on the passive subject is studied, considering that this is the main actor on which all possible activities will devolve -whether current or potential-. The constant changes in regulations and the positive evolution of corporate management, have developed greater control of analysis and study on participation, enrollment, administration and passive subject correspondence in the Company.
