Abstract

La seguridad jurídica preventiva otorgada a través del servicio notarial, es otorgada por el notario de fe pública en el momento de elaborar documentos notariales, que previamente el asesoramiento y verificación del consentimiento de las partes, se genera un documento protocolar o un documento extra protocolar. El control de legalidad de los actos, negocios jurídicos y contratos, se manifiesta en la verificación de estos en el marco del ordenamiento jurídico vigente, estableciendo si corresponde la emisión del documento notarial, dando fe de la seguridad y jurídica y el control de legalidad. La fe pública es delegada por el Estado al notario de fe pública, por lo cual está encargado de dar la seguridad jurídica y el control de legalidad de todos los documentos notariales generados en la actualidad, por lo que se explica las falencias respecto la carrera notarial, la implementación del sistema informático del notariado plurinacional, el notario de fe pública como sujeto obligado y funcionario responsable ante la Unidad de Investigaciones Financieras, los documentos notariales de créditos bancarios, para lo cual se presentan propuestas para estos cambios en el servicio notarial Se realizó el trabajo de campo a través de la recopilación de la opinión de los entendidos de la materia en derecho notarial e investigación sobre los documentos notariales protocolares y extra protocolares, por lo que se hizo una recopilación de información documental y una recopilación de información de primera mano a través de las entrevistas y las encuestas. A través de la información obtenida se elaboró las propuestas referentes a un modelo de Escuela de notarios de fe pública del Estado Plurinacional de Bolivia, un proyecto de Reglamento de actuación notarial ante contingencias del sistema informático del notariado plurinacional y un proyecto de Reglamento de actuación notarial para instrumentos públicos notariales de créditos bancarios.
