Abstract
En el trabajo se expone la posición constitucional del derecho a la propia imagen en la Constitución española, analizándose los supuestos en que es posible una injerencia en la misma, no consentida por el titular del derecho, con el fin de proteger el interés general a la libertad de información y de expresión.Se analiza, así, la posibilidad de captar o publicar imágenes de personajes con proyección social en lugares públicos o imágenes de personas carentes de notoriedad, cuando sean accesorias de un acontecimiento principal de interés público.
ABSTRACT: The paper describes the constitutional position of personal image rights in the Spanish Constitution, which is examined for possible interference in the same, without the consent of the holder of the right, in order to protect the general interest of the freedom of information and expression.An analysis is made of the possibility of making or publishing images of people of no celebrity, who are simply accessories to a main event of public interest.
