Abstract
Resumen: La actual configuración de la libertad de expresión como garantía institucional de la democracia tiene su origen doctrinal en la Inglaterra del siglo XVII, aun cuando la consolidación de la misma tendrá lugar en la Primera Enmienda norteamericana. Precisamente las tesis que, sobre la libertad de expresión en general y sobre la libertad de prensa en particular, mantuvieron los Padres Fundadores de EEUU, serán luego plenamente acogidas por la Corte Suprema norteamericana. El TEDH acabará aplicando las tesis de dicha Corte, para resolver los conflictos en que esté en juego dicha libertad.
Abstract: The current configuration of freedom of expression as an institutional guarantee of the democracy has its doctrinal origin in the seventeenth-century England,even though its consolidation was in the US First Amendment. Precisely the theses about freedom of expression in general and on freedom of the press in particular kept by the Founding Fathers of the United States, will then be fully embraced by the US Supreme Court.The ECHR has ended applying the thesis of this American Court to resol ve those conflicts in which that freedom is at stake.
