BREVE REFLEXIÓN SOBRE EL DELITO DE IMPAGO DE PENSIONES, ART. 227 CP

Abstract

RESUMEN: El delito de impago de pensiones es un ejemplo de infracción concebida para reforzar los incumplimientos de contenido civil. Ello provoca una serie de problemas interpretativos que son abordados en el trabajo, en el que se repasan los elementos más singulares del delito.Así, se estudia el bien jurídico tutelado, que se centra en la necesidad de proteger a los miembros más débiles de la familia. También será analizada la peculiar estructura típica, calificado como delito permanente, al requerir una repetición de actos para su consumación.

ABSTRACT:The offense of non-payment of pensions ¡s an example of infraction conceived to reinforce ¡nfringements of civil contení.This cause a number of interpretive problems ¡s addressed ¡n the work, ¡n which we review the most unique elements of the crime. So, we study the legally protected, which focuses on the need to protect the weakest members of the family.Also ¡t ¡s analyzed the peculiar structure will typically describe as permanent crime, to require a repetition of acts for its consummation.
