El medio ambiente sano:: La consolidación de un derecho

Abstract

RESUMEN: El objeto del presente artículo es ofrecer una aproximación al derecho a un medio ambiente sano, así como su origen y evolución, un proceso que comenzó en la década de los años setenta y que aún continúa en desarrollo. Con este fin, se examinarán los instrumentos de derecho internacional que dieron lugar a su creación, así como la jurisprudencia del Tribunal Europeo de Derechos Humanos en la materia.

ABSTRACT: The aim of this paper is to give an overall view of the substantive right to a healthy environment, its origin and evolution, a process that has been developing since the seventies. For this purpose, the international legal tools that created this right will be examined, as well as the jurisprudence of the European Court of Human Rights in environmental issues.
