La Universidad de los Andes y el instituto iberoamericano de derecho agrario y reforma agraria: una relación institucional sin resolver

Abstract

The Spanish American Institute for Agricultural Law and Agrarian Reform is a Civil Association, for factual reasons, set an apparent attachment to the Faculty of Law and Political Sciences of the University of Los Andes. The Faculty Council has twice attempted to define the irregular situation. At first, University Council requested a ruling on the legal nature of the institute in 2004, but in that opportunity no response was submitted a report suggesting the ultimate solution in 2010. Up to this day the University Council has not made public the decision of the university’s governing body, which continues to tolerate the situation and the aforementioned private entity acting at the institutional level. The aim of this paper is to open again the discussion of the case and warn of potential sanctions, both the National Council of Universities and the Comptroller General of the Republic to the irregular status above.
