Principio de prevención y precautorio en materia ambiental

Abstract

El derecho a un medio ambiente sano resulta cada día más complejo debido a las situaciones de riesgo y peligro a partir del cambio climático como proceso natural y la acción humana en cuanto al aprovechamiento de los recursos naturales de forma abusiva, generando afectaciones que vulneran y violan el derecho ambiental. Por ello, el objeto de este trabajo es reiterar la importancia de los principios de prevención y precautorio como aliciente en el sistema de acceso a la justicia, no solo de interés particular, sino colectivo del bien común. En correlación a estos principios, se destaca la vinculación con la afectación de los derechos humanos violados a partir de la no garantía y protección del derecho a un medio ambiente sano, así como la interdependencia, indivisibilidad y progresividad de los derechos humanos

The right to a healthy environment is increasingly complex due to risk and danger situations from climate change as a natural process and human action in the use of natural resources in an abusive way, generating effects that infringe and break environmental law. Therefore, the purpose of this work is to reiterate the importance of the principles of prevention and caution as an incentive in the system of access to justice, not only of particular interest, but also collective for the common good. Relating to these principles, it is highlighted the linkage with the affectation of violated human rights on the basis of the non-guarantee and protection of the right to a healthy environment, as well as the interdependence, indivisibility and progressiveness of human rights
