DOBLE MATERNIDAD. RECLAMACIÓN DE FILIACIÓN MATRIMONIAL POR POSESIÓN DE ESTADO. MATERNIDAD BIOLÓGICA Y MATERNIDAD POR FICCIÓN LEGAL: CONCURRENCIA Y SIMULTANEIDAD. COMENTARIO A LA STS 740/2013, DE 5 DICIEMBRE (RJ 2013, 7566)

Abstract

RESUMEN: ElTS considera que no se debe subordinar la determinación de la filiación derivada de la fecundación asistida en el caso de matrimonio de mujeres a un requisito formal, como el del consentimiento previo ante el encargado del Registro Civil y no ante el centro médico, en el que se prestó el consentimiento para la realización de la técnica de reproducción asistida, y a la voluntad concorde de las partes de concebir un hijo, lo que legitima el ejercicio de la acción de reclamación, reconociendo la posesión de estado en base a dicho consentimiento y a dicha voluntad, conjuntamente con otras pruebas, y teniendo en cuenta el interés de las menores y el criterio de la unidad y la estabilidad familiar de las mismas.

ABSTRACT: In the case of marriage of women and use of assisted fertilization the Supreme Court considers that it is possible the determination of the parentage arising without formal requirements, such as prior consent in the Civil Registry.The Court considers that it is sufficient to give the consent in the medical center for the assisted reproduction and the common will of conceiving a child, which legitimizes the exercise of a claim action, recognizing the apparent status based on the consent and that will, together with others evidences, and taking into account the interest of the minor and the criterion of unity and stability of the same family.
