Abstract
En Perú, la resolución de conflictos se basa en tradiciones y mecanismos ancestrales para restaurar la armonía social. El objetivo del estudio es determinar la influencia de la ética de los jueces de paz en la resolución de conflictos en la comunidad campesina de Pueblo Libre - Huancavelica. El enfoque es cuantitativo, tipo descriptivo, explicativo, diseño no experimental, retrospectivo, observacional y transversal. Se seleccionó la muestra mediante un muestreo no probabilístico por conveniencia, conformado por 30 ciudadanos. Los resultados indicaron que influye en la resolución de conflictos la ética de los jueces de paz, sus principios éticos, su capacidad de discernimiento, el debido proceso del juzgado de paz, su ideal ético en el comportamiento ético y el ordenamiento de los valores, entre otros factores. Se concluye con la necesidad de que se tomen medidas para la construcción de un sistema de justicia de paz más ético, confiable, transparente y equitativo.
In Peru, the resolution of conflicts is based on ancestral traditions and mechanisms to restore social harmony. The objective of the study is to determine the influence of the ethics of peace judges on the resolution of conflicts in the rural community of Pueblo Libre - Huancavelica. The approach is quantitative, descriptive, explanatory, non-experimental, retrospective, observational, and transversal. The sample was selected through non-probabilistic convenience sampling, consisting of 30 citizens. The results indicated that the ethics of peace judges, their ethical principles, their capacity for discernment, the due process of the peace court, their ethical ideal in ethical behavior, and the ordering of values, among other factors, influence the resolution of conflicts. The conclusion is that measures should be taken to build a more ethical, reliable, transparent, and equitable justice system.
