dc.description.abstractdemonstrating that the formal consequences of a constitutional regulation of rights are the result of the regulatory nature of the Constitution rather than the result of the existence of any specific constitutional provision and, from that feature, the rights are directly applicable, construable according to the human rights treaties that are guaranteed by a material reservation of law that must be safeguarded at a constitutional level.
