Sobre la nulidad procesal y su estado actual en chile: A propósito de la infracción al principio de juridicidad

Abstract

Resumen: Los tribunales de justicia, en el ejercicio de la función jurisdiccional del Estado, tal como en el ejercicio de cualquier otra función propia del aparato estatal, se encuentran sujetos al principio de juridicidad consagrado en la Constitución. Esto implicará que el proceso mismo, la realización dinámica de la función jurisdiccional del Estado ha de ceñirse también a lo preceptuado en el texto constitucional. Luego, es preciso analizar cuáles serían las formas de sanción a los casos de actuaciones oficiales que infrinjan lo preceptuado por el principio de juridicidad, y aquello se vinculará con la función estatal particular de que se trata; en nuestro caso, el proceso.

Abstract: The courts, in the exercise of the judicial function of the state, as in the exercise of any other function of the state, are subject to the principle of legality enshrined in the Constitution. This implies that the process itself, the dynamic performance of the judicial function of the state must also adhere to the precepts from the constitutional text. Then, it is necessary to analyze what would be the forms of punishment in cases of official actions that violate the precepts by the principle of legality itself, and that will be linked to the particular state function in question; in our case, the process.
