LOS DEBERES INFORMATIVOS DE DECLARACIÓN DEL RIESGOY DE DECLARACIÓN DEL SINIESTRO EN LA LEGISLACIÓN ESPAÑOLA

Abstract

RESUMEN: Dentro de los deberes que se imponen al asegurado sin duda son de importancia capital para el mantenimiento del equilibro en las prestaciones recíprocas, el cabal cumplimiento del deber de proporcionar información relativa al riesgo objeto de cobertura, pues de ella deriva la apreciación, por parte del asegurador, del riesgo asegurado. Por otra parte, una vez hubiera acaecido el hecho dañoso, informar del mismo corresponde también al asegurado, pues de otra manera se impide que el asegurador cumpla con su obligación de pago de la indemnización.Así pues, este trabajo aborda ambos eventos esperando que la proyecta reforma de su régimen jurídico permita una mejora del mismo.

ABSTRACT:The duties imposed on the insured certainly are of paramount importance for the maintenance of balance in the reciprocal duties of the insurance contract. Consequently full compliance with the duty to provide pre-contractual information related to the risk is relevant, since from it derives the assessment, by the insurer, of the scope of the insured risk. On the other hand, once the loss has occurred, the duty to report it also corresponds to the insured, otherwise the insurance company could be prevented to fulfill its obligation to pay the agreed compensation.Thus, this paper addresses both events hoping the projected reform allows for improvement.
