Abstract
El presente artículo hace referencia de forma sintética a algunos antecedentes que permitieron el logro de avances jurídicos en torno al reconocimiento de los derechos y el carácter de sujeto de derecho de la naturaleza o de sus componentes en los ordenamientos legales de algunos países. Asimismo, como parte central se aborda este planteamiento biocéntrico como nuevo paradigma, instaurado jurídicamente en Bolivia, no obstante, bajo algunas contradicciones y vacíos jurídicos que se han identificado y analizado brevemente con la finalidad de constatar si realmente existe una tutela jurídica de la Madre Tierra, tal como se la denomina tradicionalmente en Bolivia y si es o no efectiva, en el marco de la legislación ambiental nacional vigente
This article makes synthetic reference to some antecedents that allowed the achievement of legal advances around the recognition of the rights and the character of nature as a subject of law or of its components in the legal systems of some countries. Likewise, as a central part, this biocentric approach is addressed as a new paradigm, legally established in Bolivia, however, under some contradictions and legal gaps that have been identified and briefly analyzed in order to verify if there really is a legal guardianship of Mother Earth, as it is traditionally called in Bolivia and whether or not it is effective, within the framework of current national environmental legislation
