PROTECCIÓN POST MORTEM DE LOS DERECHOS DE LAPERSONALIDAD. REFLEXIONANDO SOBRE LA CUESTIÓN.

Abstract

El presente trabajo ofrece una reflexión acerca de la trascendencia que ofrece el Derecho a la muerte y los efectos que en relación a la memoria defuncti se generan. Igualmente se analizan las cuestiones más relevantes en relación a la LO 1/1982, de 5 de mayo, de protección civil del derecho al honor, a la intimidad personal y familiar y a la propia imagen, con especial incidencia en la posición jurisprudencial sobre la protección post mortem de estos derechos

This work gives a reflection about the significance that offers the right to death and the generated effects in relation to the defuncti memory. Also, there are analized the key issues in relation to Law 1/1982 of May 5 of civil protection of the right to honor, to the personal and familiar privacy and to the own image, with enphasis on the jurisprudential position about the post mortem protection of these rights
