Abstract
El objetivo de la investigación fue profundizar sobre la naturaleza de la responsabilidad administrativa funcional a la luz de la constitucionalidad de las normas de control contenidas en la Ley Orgánica del Sistema Nacional de Control y de la Contraloría General de la República del Perú. La investigación es cualitativa y se utilizó el método descriptivo - explicativo. Para la recolección de información se empleó como instrumento la Ley Orgánica del Sistema Nacional de Control y de la Contraloría General de la República, documentos procesales para el análisis documental, la cual registró la información recolectada en publicaciones periódicas en google scholar, bases de datos como SCIELO, SCOPUS, redes sociales como Facebook e Instagram, de la plataforma de YouTube, entre otros medios digitales. Como resultado, la función pública está en manos de personal que brinda servicios públicos que satisfacen el interés general y bien común conforme a un ordenamiento jurídico que deriva de la Constitución y la ley. En ese contexto, el TC ha ratificado la constitucionalidad de potestad sancionadora de la Contraloría General de la República en el proceso para sancionar en materia de responsabilidad administrativa funcional, sin embargo, no acepta el artículo 46 de la Ley Nº 29622, Ley Orgánica de la Contraloría General de la República, por incurrir en falta de tipicidad de las infracciones.
The objective of the investigation was to delve into the nature of functional administrative responsibility in light of the constitutionality of the control standards contained in the Organic Law of the National Control System and the Comptroller General of the Republic of Peru. The research is qualitative and the descriptive-explanatory method was used. To collect information, the Organic Law of the National Control System and the Comptroller General of the Republic was used as an instrument, procedural documents for documentary analysis, which recorded the information collected in periodical publications in Google Scholar, databases such as SCIELO, SCOPUS, social networks such as Facebook and Instagram, the YouTube platform, among other digital media. As a result, the public function is in the hands of personnel who provide public services that satisfy the general interest and common good in accordance with a legal system that derives from the Constitution and the law. In this context, the TC has ratified the constitutionality of the sanctioning power of the Comptroller General of the Republic in the process to sanction matters of functional administrative responsibility, however, it does not accept article 46 of Law No. 29622, Organic Law of the Comptroller General of the Republic, for incurring a lack of typicality of the infractions.
