LAS POSIBILIDADES DE UN DESPIDO OBJETIVO DELART.52.C) E.T. DURANTE UN ERETEMPORAL. COMENTARIO A LA STS DE 12 DE MARZO DE 2014
Abstract
RESUMEN: Un trabajador fue despedido mediante despido objetivo por causas económicas y productivas, durante la vigencia de un expediente de regulación de empleo temporal (ERTE) que afectaba también a dicho trabajador. La cuestión a debate es si una empresa a la que en el marco de un ERTE se le ha autorizado a suspender temporalmente contratos de trabajo, puede durante tal período, por las mismas causas alegadas y sin que haya habido un cambio relevante en las circunstancias, efectuar un despido objetivo de alguno de los trabajadores afectados por la suspensión de contrato.
ABSTRACT: The Court ruling that we are analyzing decides the case of a worker who has dismissed individually, during a period of collective supensions of a various workers contracts, due to economical causes, which also affected the same employee.The key question is if a company who has been authorized to suspend the labour contracts of various workers, due to economical causes, can during the same period and alleging the same causes, without a relevant change of circumstancies, individually dismiss one of the workers who has had his contract suspend.
