El estado único de hijo en Italia

Abstract

El presente artículo estudia las relaciones paterno-filiales en Italia, a través de una perspectiva diacrónica, a partir del Código civil del 1865 hasta la reciente reforma del 2012. El estudio pretende profundizar las razones histórico-jurídicas de la tradicional regulación dispar entre la filiación legítima y la natural y, además, analizar el camino jurídico que ha permitido llegar hoy a la proclamación de la paridad de todos los hijos, con independencia de la condición de los progenitores.

This article examines the relationship between the parent and the children in Italy trough a diachronic perspective, from the Civil Code of 1865 to the recent 2012 reform. The study attempts to deepen the historical and the juridical reasons of the traditional unequal treatment between legitimate children and the natural one. Also it attempts to analyse the juridical route that allows to arrive today to the proclamation of equality of all children, independently from the matrimonial status of progenitors.
