¿Cuenta el ordenamiento jurídico cubano con herramientas suficientes para tutelar el derecho de disposición sobre el cadáver?

Abstract

Con las presentes líneas se busca reflexionar sobre la deficiente protección del derecho de disposición sobre el cadáver en el ámbito sustantivo y procesal civil en Cuba. Se parte de analizar los aciertos y desaciertos de la regulación de este derecho en los espacios mencionados, y la necesidad de atemperar nuestras normas a la naturaleza jurídica del mismo en aras de prevenir litigios y que el derecho objeto de estudio se pueda realizar de forma más completa, en tanto y en cuanto se modifique la legislación vigente. Además se analiza críticamente la última sentencia dictada por el Tribunal Supremo de Cuba sobre la materia, y se trata de ilustrar como se manifesta esa insuficiente tutela ante una faceta concreta de este derecho.

With these lines we seek to reflect about the poor protection of the right to dispose of the corpse in the substantive and procedural civil law in Cuba. It starts analyzing the successes and failures of regulation of this right in the mentioned areas, and the need of our law to understand it essence, in order to avoid future litigation and that the right under study can be performed in a more fully way, as long as the legislation is modified. In addition, the last sentence issued by the Supreme Court of Cuba on the subject is critically analyzed, and it is a question of illustrating how this insufficient protection is manifested before a specific facet of this right.
