Abstract
La Constitución boliviana reconoce a toda persona el derecho a presentar ante el Tribunal Constitucional Plurinacional, sin intermediación de entes o servidores públicos, una acción de inconstitucionalidad que active el control correctivo de constitucionalidad. Esta novedosa acción no está desarrollada en las leyes y no fue activada por ese Tribunal, razón por la que corresponde operar los correctivos para permitir el real y efectivo ejercicio de ese derecho, toda vez que ello aporta a la construcción de un verdadero Estado constitucional de Derecho.
According to the bolivian Constitution, everyone has the right to submit directly before the Plurinational Constitutional Court, a constitutional motion to activate the judicial review without the intervention of any authority or public officials. Unfortunately, laws and the Plurinational Constitutional Court have not developed nor activated that action, which could be a potential tool in order to contribute to build up a genuine Constitutional state, consequently, the Plurinational Constitutional Court should fix this scenario in order to make real and effective that right.
