Las reglas de Rotterdam sobre transporte marítimo internacional: the definition of the scope
Abstract
El presente trabajo analiza la propuesta de la UNCITRAL conocida de forma generalizada como las Reglas de Rotterdam a favor de la unificación de la regulación del transporte marítimo internacional. Concretamente, estas Reglas no pueden considerarse en una tradición puramente continuista a sus antecesoras y vigentes Reglas de la Haya y de Hamburgo. Precisamente por la importancia de los cambios que introducen las Reglas de Rotterdam, resultan de especial importancia los criterios de delimitación del ámbito de aplicación tratados en el presente trabajo. La aceptación por parte de los Estados miembro para su futura entrada en vigor, y sobre todo, los cambios materiales relativos la ampliación de la responsabilidad del porteador (junto a la complejidad en la delimitación de su responsabilidad) se erigen como cuestiones clave en el panorama regulador que bajo la perspectiva "puerta a puerta", trata de contemplar el fenómeno de la contenerización en el transporte internacional.
This paper analyzes the proposal from the UNCITRAL widely known as the Rotterdam Rules for the unification of regulation of international maritime transport. Specifically, these rules can not be considered a purely continuistatradition to its predecessors and current Hague Rules and Hamburg. Precisely because of the importance of the changes introduced by the Rotterdam Rules, are particularly important criteria delimiting the scope covered by this work.Acceptance by the Member States for their future entry into force, and especially the material changes concerning the extension of the carrier's liability (next to the complexity of the delimitation of their responsibility) stand as key issues in this context where the perspective "door to door", is contemplating the phenomenon of containerization in international transport.
