¿Cosmopraxis, conciliación o cobardía? Análisis de unos libros de Justicia en los Yungas

Abstract

En este texto se critica las publicaciones sobre justicia comunitaria por basarse en versiones normativas y carecer de estudios de casos reales, delitos cometidos y procedimientos aplicados para solucionarlos. Consta la dificultad de acceder a los casos reales; incluso si se dispone de los libros donde están registrados, éstos apenas registran los acuerdos finales y no explican los antecedentes ni los contextos del delito. Tampoco registran las muchas demandas que no llegan a una solución. De esta manera se exagera tanto la efectividad de la justicia comunitaria como su supuesta otredad respecto a la justicia ordinaria.

Critiques publications on community justice as based on normative versions and lacking studies of real cases, the crimes committed and the procedures applied to resolve them. Demonstrates the difficulty in getting access to real cases; even if one disposes of the books where they are registered, these barely note the final agreements and do not explain the previous facts of the case nor the context in which the crime occurred. Nor do they register the many demands which do not reach a solution. In this way they exaggerate both the effectiveness of community justice and its supposed otherness with respect to state justice.
