La teoría del servicio público y su aplicación real en materia de acueducto durante la década de los treinta

Abstract

During the 30�s the notion of public service was in the middle of a State systematic\njuridical construction; the pioneer of its organization was León Duguit, and its\nacceptance in Colombia caused a certain impact on the internal State policy\nduring the first half of the 20th century.\nConsequently, this article is intended to analyze whether the ideas brought from\nthe French school during the 1930-1940 period were really reflected on the\nState activity and public services or their influence was simply a statement, and\nthe topic only remained as a legal and constitutional dogmatic discussion. This\nvalidation exercise for the case of Bogotá allows showing an active notion of the\npublic service, fulfilling with the State social function.\nIn order to fulfill the objective proposed, two water supply public service rendering\nissues are studied; first, it is important to verify in both records and Law 65,\n1936 (Republic of Colombia, 1936A)1 that the issues were maybe influenced by\nthe doctrinal tendency named above; second, something similar occurred when\nrendering this public service in Bogotá City between 1930 and 1940.
