La aplicación del derecho al olvido en España tras la STJUE Google contra AEPD y Mario Costeja

Abstract

RESUMEN: El presente artículo analiza el modo en que el derecho al olvido se está configurando en España, tras el importante pronunciamiento del TJUE en el caso Google contra AEPD y Mario Costeja. Para ello, tras resumir brevemente la famosa sentencia del TJUE, se estudian las primeras sentencias recaídas en nuestro país en materia de derecho al olvido, tanto de la Audiencia Nacional como del Tribunal Supremo. El artículo subraya las cuestiones que todavía plantean ciertas divergencias interpretativas a la hora de aplicar el conocido como derecho al olvido.

ABSTRACT: The present article analyzes how the right to be forgotten is taking shape in Spain, after the important statement of the ECJ in the case Google vs AEPD and Mario Costeja.After a brief summary about the ECJ's famous ruling, the first resolutions of the Spanish Courts in relation with the right to be forgotten are analyzed.The article highlights the issues that are still open to discussion in daily application of this right.
