Las dificultades que el actual paradigma subjetivista de la salud comporta en su configuración como derecho humano universal

Abstract

El trabajo analiza, en primer lugar, las exigencias e implicaciones que conlleva el reconocimiento de la salud como derecho humano, su fundamento y justificación y el modo de garantizarlo jurídicamente como derecho social esencial. En segundo lugar, se aborda el concepto subjetivista de salud a partir de la definición adoptada por la OMS y los problemas que comporta para identificar el contenido esencial del derecho a la salud y la realidad de la atención sanitaria en el primer y tercer mundo.

The paper analyses, firstly, the requirements and implications derived from the acknowledgment of health as a human right, its foundation and justification and the means to legally guarantee it as an essential social right. Secondly, it is considered the subjective concept of health from the definition adopted by the WHO and the problems thatthis definition raises in order to identify the essential contents of the right to health and the reality of the sanitary attention in the first and the third world.
