RESPONSABILIDAD CIVIL MÉDICA POR PRIVACIÓN DE LA FACULTAD DE OPTAR POR EL ABORTO

Abstract

RESUMEN: El presente artículo analiza la delicada cuestión de la responsabilidad civil médica en relación con el nacimiento del ser humano. Desde estas líneas, se critica la oscilante jurisprudencia del TS, y se propone la tesis de que el único daño moral que puede resultar indemnizable es la privación a la madre de la facultad de optar por el aborto, sin que pueda constituir un daño, en ningún caso, el nacimiento mismo del ser humano.

ABSTRACT:This paper analyzes the sensitive issue of medical liability ¡n connection with the birth of the human being. From these lines, we criticize the Supreme Court's jurisprudence on the subject, which ¡s very variable. Also, we propose the thesis that the only moral damage which may be compensable ¡s the privation of the faculty to choose the abortion. May not be a damage, ¡n any case, the birth of the human being.
