Abstract

RESUMEN: La incapacidad para suceder ex artículo 470 del Código Civil cubano no se aplica si en fase de adjudicación hereditaria, el emigrante ha retornado al país, reasentándose en este. De modo que se "rehabilita" para suceder. De tal manera, el tratamiento de esta causal de incapacidad, rectius, de exclusión para suceder, tiene una naturaleza especial, al no hacerse coincidir necesariamente la capacidad para suceder, en estos extremos, con el momento del deceso de quien deviene causante.

ABSTRACT: The inability to succeed ex Article 470 of the Cuban Civil Code does not apply if in the phase of hereditary adjudication, the emigrant has returned to the country, resettling in it. So that it "rehabilitates" to succeed. In this way, the treatment of this causality of disability, rectius, of exclusion to succeed, has a special nature, since the ability to succeed, in these extremes, does not necessarily coincide with the moment of death of the person.
