EL RÉGIMEN DE SEPARACIÓN DE BIENES EN LA LREMV

Abstract

RESUMEN: El presente artículo versa sobre la nueva Ley valenciana de régimen económico matrimonial y su régimen económico supletorio: la separación de bienes. En él se discute la constitucionalidad de la ley, se analiza su ámbito de aplicación, se examina el régimen jurídico de separación de bienes como régimen supletorio así como la obligación de los cónyuges de levantamiento de las cargas del matrimonio, especialmente importantes cuando aquel sea de aplicación, dada la separación de patrimonios.

ABSTRACT:This article is about the new law of matrimonial property regime in Valencia and supplementary economic system: the separation of property. It discusses the constitutionality of the law, discusses its scope, it examines the legal regime of separation of property as default regime and the obligation of spouses to lift the burdens of marriage, especially important when one is in implementation, given the separation of assets.In this context, the paper explains the concept of general conditions and unfair terms. Also, it highlights the importance of double checking-inclusion test and unfairness test- in order to guarantee the protection of consumer's interests.
