La garantía registral (anotación preventiva) del legado

Abstract

La normativa registral inmobiliaria, tras restringir las hipotecas legales tácitas, configura la anotación preventiva del legado para atender, transitoriamente, el peligro de que el heredero, con actos propios, pueda aludir su entrega o pago; este régimen novedoso en la época codificadora, y que ha perdurado hasta el presente, es objeto de examen en su globalidad para aquilatar su fundamento actual y de revisión en cuestiones puntuales derivadas de los sucesivos cambios actualizadores del sistema registral.

In the regulation of property registration, traditional tacit legal mortgages are dealt with by means of their preventive annotation. This way, heirs are prevented from possible acts directed towards the avoidance of the legacy. This regulation was novel to the civil code and has lasted to present. Therefore, it is necessary to rethink its purpose and to review specific issues that arise from the updating changes of the registry system.
