Abstract

RESUMEN: La atribución del uso de la vivienda familiar realizada por los esposos a uno de ellos en convenio regulador implica la pérdida de la condición de "familiar" de la vivienda, lo que impide que posteriormente pueda ser atribuida al cónyuge custodio al amparo del art. 96.I CC. En este caso, la contribución a la satisfacción de la necesidad habitativa por el cónyuge usuario deberá sustanciarse a través de la pensión de alimentos.

ABSTRACT: The attribution of the use of the family home made by the spouses to one of them in a regulatory agreement implies the loss of the "family" status of the home, which prevents it from being subsequently attributed to the custodial spouse under art. 96.I CC. In this case, the contribution to the satisfaction of the housing need by the user spouse must be carried out through the alimony.
