Tacones lejanos. Representaciones en el debate del proyecto de ley de reparación histórica para personas mayores travestis y trans en Argentina

Abstract

Este artículo se propone como objetivo general analizar las representaciones sociodiscursivas surgidas en el debate legislativo del proyecto de ley de reparación histórica para personas mayores travestis y trans en Argentina como herramientas de reconocimiento a partir de la creación de la Pensión Reparatoria para Personas Mayores Travestis y Trans de la cual serían posibles beneficiarios/as. En Argentina, a once años de la sanción de la Ley 26.743 que establece el derecho a la identidad de género de las personas, diversos grupos activistas travestis y trans reclaman por una Ley de Reparación Histórica como un modo de indemnización compensatoria que pretendería reparar el daño ocasionado por la violencia institucional que sufrió este colectivo por acometer contra su identidad de género y la vulneración de sus derechos humanos. El análisis de las representaciones sociodiscursivas en el tratamiento discursivo de este proyecto de ley en la Cámara de Diputados es de gran importancia para distinguir y estudiar las herramientas contra las discriminaciones, los procesos de empobrecimiento de las personas travestis y trans y el reconocimiento de derechos. El análisis de los discursos legislativos acontecidos el 24 de mayo de 2023 pretende ahondar en la evolución de las resignificaciones del reconocimiento de los derechos de este colectivo con la posibilidad del otorgamiento en carácter vitalicio de una pensión reparatoria.

This article aims to analyze the socio-discursive representations that have emerged in the legislative debate on the bill for historical reparations for elderly transgender and trans individuals in Argentina as tools of recognition through the creation of the Reparatory Pension for Elderly Transgender and Trans Individuals, who could potentially be beneficiaries. In Argentina, eleven years after the enactment of Law 26.743 which establishes the right to gender identity for individuals, various transgender and trans activist groups are advocating for a Historical Reparations Law as a form of compensatory indemnification that seeks to address the harm caused by institutional violence suffered by this community due to their gender identity and the violation of their human rights. The analysis of socio-discursive representations in the discursive treatment of this bill in the Chamber of Deputies is of great importance for identifying and studying tools against discrimination, the processes of impoverishment of transgender and trans individuals, and the recognition of rights. The analysis of the legislative discourses that took place on May 24, 2023, and will continue in mid-June 2023, aims to delve into the evolution of the resignifications of the recognition of the rights of this community with the possibility of granting a reparatory pension on a lifelong basis.
