Patria potestad y educación religiosa de los hijos menores

Abstract

El artículo analiza los conflictos en el ámbito educativo que surgen en la relación entre el derecho de libertad religiosa y el ejercicio de la patria potestad. En primer lugar estudia la relevancia de las creencias religiosas de los progenitores en los procesos de atribución de custodia y determinación de régimen de visitas. En segundo lugar trata del desacuerdo entre los titulares de la patria potestad respecto a la educación religiosa del menor. Y finalmente, se refiere a los conflictos entre los padres y el menor en el ejercicio del derecho de libertad religiosa.

The article analyzes the conflicts that come up between the right of religious freedom in education and the exercise of parental authority. On one hand, it studies the relevance of the religious beliefs of the parents on the processes of attribution of custody and determination of the visiting arrangements. On the other hand, it deals with the disagreements between the parents regarding to the religious education of the minor and the criteria to follow by the judge at the judicial resolution. Finally, it refers to the conflicts between the parents and the minor on the exercise of the right of religious freedom.
