Abstract

RESUMEN: En este comentario de jurisprudencia se examinan distintas sentencias del Tribunal de Justicia de la Unión Europea para dilucidar si son subsumibles en el ámbito de aplicación del forum delicti commissi del art. 5.3 del Reglamento Bruselas I (art. 7.2 del Reglamento Bruselas I bis) las acciones declarativas negativas cuando, en el marco del proceso de no infracción de patente en el que se planteen, se alegue la invalidez del derecho de patente afectado.

ABSTRACT:This case-law comment analyzes several judgments of the Court of Justice of the European Union in order to assess whether the forum delicti commissi rule contained in art. 5(3) of the Brussels I Regulation -art. 7(2) of the Brussels I Recast- covers actions for a negative declaration when, in the framework of a process of non-infringement of a patent right, the question of invalidity of the patent at stake is risen.
