Abstract
RESUMEN: La imposibilidad de cumplimiento de la prestación excluye la situación de mora y produce un incumplimiento definitivo al verse frustrado el interés del acreedor. Para que exista la novación, sea con efectos modificativos o extintivos de la obligación originaria, es necesario el acuerdo de las partes.
ABSTRACT:The lack of payment or breach of contract excludes the default and produces a final non-fulfilment because the creditor's interest becomes frustrated. For that there is a novation, either with amending or extinctive effects of the originative obligation, the agreement of the parties is required.
