El arbitraje marítimo internacional en las reglas de Rotterdam
Abstract
El presente trabajo analiza las soluciones que contiene el Convenio de Naciones Unidas sobre el contrato internacional de mercancías total o parcialmente marítimo, conocido, comúnmente, como las Reglas de Rotterdam sobre una de las cuestiones más emblemáticas en estos momentos en el transporte marítimo internacional. Nos referimos a los problemas que plantea la eficacia de los acuerdos de arbitraje en el ámbito del Derecho marítimo debido fundamentalmente a las especiales características que rodean a este sector del comercio internacional. Para ello, es necesario señalar la existencia de una pluralidad de fuentes normativas susceptibles de regular la cuestión en la actualidad. Asimismo, resulta imprescindible analizar la regulación contenida al respecto en los instrumentos normativos existentes de carácter internacional haciendo hincapié, además, en la disparidad de soluciones que ofrecen los diferentes sistemas estatales a nivel de Derecho comparado.
