dc.description.abstractThe objective of this paper is to study the Supreme Court of Justice of Colombia’s interpretation on the rights of future generations in the judgement STC4360-2018. In this case, the Supreme Court recognized rights to the Colombian Amazon through a reinterpretative exercise in which it considered the rights of nature and the rights of future generations as part of the same protected legal interest. The methodology used includes a documentary analysis, with a systematic hermeneutical approach to the doctrine, jurisprudence, and regulations compiled in specialized databases. This aims to examine the before and aftermath of the judgment, which becomes the most relevant precedent on the recognition of the rights of future generations in Colombian Law. As a result, the authors present some considerations about the judgment and propose elements of discussion about the need to redefine the rights of nature in favor of current and future generations.
