Abstract

Resumen: En este ensayo se repasa una historia de la teoría de la separación de poderes, desde sus antecedentes en la antigüedad griega y romana, su formulación en la modernidad jurídica que acompañó el nacimiento de los estados y de las constituciones escritas, hasta los cambios registrados con el nuevo paradigma del Estado Constitucional de Derecho. Actualmente esta teoría se concentra en diferenciar entre los órganos de gobierno, que incluyen al ejecutivo y al legislativo y los órganos jurisdiccionales y de control de constitucionalidad, es decir los que incluyen al órgano judicial y al tribunal constitucional

Abstract: This essay reviews a history of the theory of the separation of powers, from its antecedents in Greek and Roman antiquity, its formulation in legal modernity that accompanied the birth of states and the written constitutions, to the changes registered with the new paradigm of the Constitutional State of Law. Currently, this theory focuses on differentiating between the government bodies, which include the executive and the legislative, and the jurisdictional and constitutional control bodies, that is, those that include the judicial body and the constitutional court
