INDEMNIZACIONES DE DAÑOSY PERJUICIOS E INTROMISIONES ILEGÍTIMAS EN LOS DERECHOS AL HONOR, A LA INTIMIDADYA LA PROPIA IMAGEN

Abstract

El art. 9.3 LO 1/1982, de 5 de mayo regula la indemnización de los daños y perjuicios irrogados por las intromisiones ilegítimas en los derechos al honor, a la intimidad y a la propia imagen. El precepto presume la existencia de daño siempre que se produzcan dichas intromisiones. Sin embargo, resulta controvertido el alcance y naturaleza de esa presunción. El presente estudio se destina a analizar la posibilidad de que no todas las intromisiones ilegítimas originen un derecho indemnizatorio

The art. 9.3 in the law 1/1982, May 5 regulates the issue of compensation for the damages incurred by the illegitimate intrusions in the rights to honour, to the privacy and image. The precept presumes the existence of damage whenever there are such intrusions. However, it is a controversial issue the scope and nature of that presumption.The present study is intended to discuss the possibility that not all illegitimate intrusions originate a right of compensation
