Luchas Locales, Cortes Internacionales: Una Exploración De La Protección Multinivel De Los Derechos Humanos En América Latina (Local Struggles, International Courts: An Exploration of the Multilevel Protection of Human Rights in Latin America)

Abstract

La proteccion de los derechos humanos depende, de manera creciente, de una apropiada interaccion entre los sistemas juridicos nacionales e internacionales. Este articulo interpreta esa dinamica como una “proteccion multinivel”, y explora las oportunidades y desafios que la misma presenta para America Latina. El texto hace primero una introduccion al concepto de “proteccion multinivel”, indagando sus origenes y contextos de creacion. Asi mismo, investiga las instancias de proteccion multinivel de los derechos humanos en America Latina, y concluye que las mismas se concentran en el sistema interamericano. ?Como empezar a pensar, entonces, la interaccion entre ese sistema y las cortes nacionales de la region? El articulo se concentra en esa pregunta, y presenta dos modelos analiticos para responderla: de una parte, el constitucionalismo interamericano y, de otra, el pluralismo juridico. Cada una estas posibilidades implica oportunidades y desafios, que son discutidos en la conclusion.Human rights protection depends, increasingly, on an appropriate interaction between domestic and international legal systems. This article interprets this dynamic as a “multi-level protection”, and explores the opportunities and challenges it presents for Latin America. The text first introduces the concept of “multi-level protection”, investigating its origins and context of creation. It also seeks for instances of multi-level protection of human rights in Latin America, and concludes that they are to be found mostly in the Inter-American System. How to start thinking, then, about the interaction between that system and national courts of the region? The article focuses on this question, and presents two analytical models to answer it: Inter-American Constitutionalism, and legal pluralism. Each of these possibilities involves opportunities and challenges, which are discussed in the conclusion.
